So as I said in another thread I bought some lights on ebay and when I recieved them they are much worse than described..

Here is the ebay auction, http://www.ebay.com/itm/320892533296?ssPageName=STRK:MEWNX:IT&_trksid=p3984.m1497.l2649

I bought them because I just needed lenses and reflectors so didn't care they had no wire or "brush guard"

but when I got them the lenses are ratling inside the case so I opened them up and here is what I found...

Broken Pivot Clip...

Broken clip in second headlight...

This one is blurry but it shows that the headlight was glued into the housing originally or something.. that clear stuff is bits of the lens stuck into the housing so it either melted or was glued

So I haven't contacted seller yet which I will definitely do but would you guys bother making a claim if he doesn't refund money?

I would most definitely if the listing did not mention all that was wrong with them then that is a problem but talk to the seller first and go from there maybe he will make it right with you (if he wants to keep a good rep with ebay that is)

Hell, in condition it says "The item may have some signs of cosmetic wear, but is fully operational and functions as intended"...

It's not functional if clips are broken... You got ripped on that one, bro. Take it to the seller in a calm, professional manner, give him a chance to make it right.

If he won't, that's one where I'd unleash my wife and send her after them...lol...

i would talk to the seller first but i think it said no returns, so you might have to file a claim. also for that much money it is worth it to make a claim, any money lost no matter how small or large of a sum is still money lost.

So I sent him this message...

Hi I just received these lights from you and they are in much worse condition than described. The second I took the lights out of the packaging they are obviously broken as the lens's rattled inside them.. upon inspection several of the clips are broken and the lens's themselves had been previously glued or melted to the case and ripped apart.. I have taken several pictures of the item which can be viewed here... http://s1226.photobucket.com/albums/ee415/dr3d3d/Banshee Headlight Defects/

I realize these items are used and wear and tear is to be expected but as written in the terms you agreed to an item should function as intended and these will not be usable at all as they do not seal and would rattle while riding... here is how ebay describes a used item..

"Used: An item that has been used previously. The item may have some signs of cosmetic wear, but is fully operational and functions as intended."

Please let me know how you intend to resolve this issue.

Which he responded with this...

Send them back for a refund.

To Which I responded with...

I can certainly do that I need an address and the cost of shipping them back refunded as well. The other option that I will be happy with is you could refund $20 back to me to pay me for the time it would take to fix them so that they are usable.

I would put in claim but even paypal wont give you return shipping back. Just like a store you eat cost of return shipping

well its obvious he purposefully tried to screw whoever the potential buyer was so why should I have to pay $10-15 and 1.5h of my time to ship them back just so he can screw someone else?(I would have to drive to states to ship them as im in Canada and shipping from here would cost $40+)

and if this was a store I would NEVER eat the cost of return shipping I would have them send me a pre-payed shipping box whenever you ask them to do this the store always says yes right away.

To be honest for the $40 I wont bother sending them back if that's what he wants its not worth my time.

So I was reading through this guys feedback and he mostly buys stuff... Here is one of his comments to another seller...

" Follow-up by zrxva (Jan-10-12 00:18):
Purchased item, took it apart and broke it. Wanted me to pay for damage. NO!
Reply by jgarcia.2 (Jan-10-12 18:51):
ZRXVA IS A HORRIBLE SELLER AND VERY DISHONEST! SOLD ME A BROKEN ITEM!"

to bad to much time has passed to see what the item was lol... but a bit of a hypocrite none the less

thats not gonna happen

then he will get a bad mark on his feedback simple as that... I should not have to pay to send something back when he knowingly shipped it broken hoping someone wouldn't bother disputing it.

If something happened in shipping etc and it wasnt his fault then yea he shouldnt have to cover it but he KNOWINGLY sent them broken

well the seller sent this back "Ok thats fine. I will refund u $20 tonight." so while he dealt with it to my satisfaction he still should have been honest in the first place

I am going to grudgingly give him positive feedback because he dealt with it but he was dishonest and unfortunately neutral feedback on ebay has become known as bad and I dont want to punish him for doing the right thing in the end.

As far as the lights go I will screw the lenses on to the reflectors and use my old housings as the reflectors on these new ones are MINT and I also needed new bushings that attach them to the bar as I cant find my old ones(think i lost them on a trail)

there should be a spot where you can type out a comment i would do a short gist of what happened in there for others

I gave him positive feedback with low marks on "Item Description" and left the comment of "Item worse condition than described but problem dealt with adequately and quickly. I am Happy"
